Zakaah Miscellany: Zakaah For Debt Conversion?

Question:

Is it permissible for a person who is owed a debt to give zakaah to the debtor on condition that he gives it back to payoff his debt?

Answer:

Praise be to Allaah. It is permissible for a person to give zakaah to someone who owes him money but cannot pay him back, so long as he does not stipulate that he must give it back to him. AI-Nawawi (RAH) said in al-Majmoo' (6/198):

"But if he gives him zakaah on condition that he gives it back to him in payment of his debt, the giving is not valid and the zakaah is not waived, according to scholarly consensus".

Shaykh Ibn 'Uthaymeen (RAH) was asked: is it permissible for the one who is owed money to gives zakaah to the poor person who owes him money on condition that he give it back to the giver to pay off his debt?

He replied: "If you are owed money by a poor person and you give him your zakaah, there is nothing wrong with that even if he gives it back to you later on. However, stipulating that he must do that is not permissible, because if you do that, then we know that you only wanted to do that so that you would get back your money that is owed to you of the poor person, and it is not permissible when paying zakaah to serve one's own interests or the interests of anyone else". (Majmoo' Fataawa ( 18/378)).

No Zakaah On Delayed Compensation

Question:

The State took away some land of mine in order to build a road, and gave me compensation for taking away the land, but I cannot take possession of this money until several years have passed. Do I have to pay zakaah on it?

Answer:

Praise be to Allaah. You do not have to pay zakaah on this money until you take possession of it; when you take possession of it you should count one (hijri) year from the day you took possession of it, then pay zakaah on it after one year.

Shaykh Ibn Baaz (RAH) was asked a similar question, and he replied:

"If property has been seized and its value estimated, but the owner has not been able to take possession of it due to  reasons beyond his control, no zakaah is due on it until he takes possession of its price and a full year has passed". (Majmoo' Fataawa Ibn Baaz[ 14/4 I])And Allaah knows best.
